Ordinance No. 5/2007

Upon accepting the recommendation of the petitioner- Commission, the State Government issued the Andhra Pradesh Reservation in favour of Socially and Educationally Backward Classes of Muslim Ordinance, 2007(Ordinance No.5/2007) grouping the newly identified socially and educationally backward classes/groups in the Muslim Community as group `E’ and providing reservation of 4% in their favour.

Vide G.O. Ms. No. 23 dated 7.7.2007 issued by the Government of Andhra Pradesh, the said Ordinance was given effect by providing for reservation in accordance with the same in educational institutions.

However, on 16.7.2007, T.Muralidhar Rao and another filed Writ Petition No.15267 of 2007 before the High Court of Andhra Pradesh at Hyderabad challenging the said G.O.Ms. No.23 (dated 7.7.2007). Certain other Writ Petitions were also filed challenging the said ordinance.

On 13th August, 2007, the A.P. Ordinance No.5 of 2007 was replaced by The Andhra Pradesh. Reservation in favour of Socially and Educationally Backward Classes of Muslims Act, 2007 (Act No.26 of 2007).

At this stage it is relevant to state that at present in the State of Andhra Pradesh, reservation provided for SCs/STs/BCs are at 50%  within the ceiling limit of 50% stipulated by this Hon’ble Court in Indra Sawhney vs. Union of India (supra) which would be clear by the following statement.

Scheduled Castes 15%
Scheduled Tribes 6%
Backward Classes 29%
